Ms. Olga Gavrikova, Kamminer Straße 3, 10589 Berlin (hereinafter referred to as “LA OL’ MARKT” or “Provider”), operates an online marketplace for fashion and accessories under the name LA OL’ MARKT via the domain https://la-ol.com.
These General Terms of Use (hereinafter referred to as “Terms of Use”) govern the use of the platform by registered users.
Any deviating terms and conditions of the users shall only apply if LA OL’ MARKT has expressly agreed to them in writing.

I. Description of Services
LA OL’ MARKT provides an online platform through which users, acting as sellers, can publish advertisements (hereinafter “Listings”) for their products. Interested parties can view these listings and communicate with sellers via an internal messaging system.
LA OL’ MARKT is not a contracting party to any sales agreements concluded between users. The platform serves solely as a contact point.
For the purpose of promoting listings, LA OL’ MARKT may distribute content on external platforms and in other media (e.g., print, online, social media). The seller grants LA OL’ MARKT a royalty-free right of use for the promotion of their listings.
II. Registration and Conditions of Use
Full use of the platform is only permitted for individuals aged 18 and above. Minors require the consent of their legal guardians. LA OL’ MARKT may request proof of such consent.
Users must provide truthful and complete information during registration and update any changes immediately in their user account.
Only one user account per person is allowed. The use of temporary or “disposable” email addresses is prohibited.
By submitting the registration form, users make an offer to enter into a user agreement. The agreement is concluded when LA OL’ MARKT confirms registration by email and the user account is verified.
Passwords must be kept confidential. If misuse is suspected, passwords and access data must be changed immediately, and LA OL’ MARKT must be informed.
LA OL’ MARKT may make the use of certain functions subject to additional requirements (e.g., verification, usage history, payment behavior).

III. Special Obligations of Users
Users are solely responsible for the content of their listings and communications.
Contracts for goods or services are concluded exclusively between users. LA OL’ MARKT is not a contracting party.
Sellers must independently comply with legal requirements, in particular regarding withdrawal, returns, warranties, taxes, and labeling obligations.
Sellers are required to clearly state their refund policies in their listings and to inform customers that LA OL’ MARKT is not liable.
The use of the platform for data harvesting, address collection, advertising outside of LA OL’ MARKT, or for the distribution of spam, viruses, or automated access methods (e.g., scraping, crawling) is prohibited.
Content from other users may not be copied, modified, or distributed.
All users are responsible for backing up their own content (e.g., listings, messages, invoices).
IV. Publication of Listings
Publishing listings is free of charge for the first three months. From the fourth month onward, a monthly fee of €40 will be charged.
A commission of 15% of the net sales price is payable to LA OL’ MARKT for each sale.
LA OL’ MARKT may limit the number of free listings per user and influence their placement (e.g., lower ranking for a large number of listings).
The platform may review listings for compliance with the Terms of Use and legal requirements and may delay or refuse publication.
V. Paid Additional Options
Users can purchase paid options to increase the visibility of their listings.
Before booking, users will be explicitly informed of the costs.
Fees are due immediately and must be paid using the provided payment methods.
Invoices are provided exclusively in electronic form.
If a listing with a paid option violates the Terms of Use, it may be blocked without any right to a refund.
VI. Content Requirements for Listings
All listings must be truthful, complete, and clearly described.
Contact details may only be provided in the designated fields. No email addresses, messenger usernames, or similar may be included in the listing text or images.
Listings may not contain illegal content or offers, particularly:
- Counterfeit, stolen, or copyright-infringing products
- Symbols of unconstitutional organizations (including disguised forms)
The provisions of German and international copyright, trademark, and competition law apply.
VII. Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must notify us (LA OL’ MARKT – Olga Gavrikova, Kamminer Straße 3, 10589 Berlin, Email: info@la-ol.de) of your decision by means of a clear statement (e.g., letter or email). You may use the attached sample withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send the notification of exercising your right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
In the event of withdrawal, we will refund all payments received from you immediately and at the latest within fourteen days from the day we receive notice of your withdrawal. The refund will be made using the same payment method used for the original transaction.
If you have requested that services begin during the withdrawal period, you must pay an appropriate amount for the services already provided.
Special Notes
The right of withdrawal expires prematurely if we have fully provided the service and have only started execution after you have expressly agreed and acknowledged that you will lose your right of withdrawal once the contract is fully performed.

VIII. Liability of LA OL’ MARKT and Dispute Resolution
LA OL’ MARKT is liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
In the case of slight negligence involving the breach of essential contractual obligations, liability is limited to foreseeable damages typical for the contract.
Further liability is excluded. There is no guarantee of uninterrupted platform availability.
Listings are provided by users. LA OL’ MARKT accepts no responsibility for their content or quality.
The European Commission provides an online dispute resolution platform at http://ec.europa.eu/consumers/odr/. However, LA OL’ MARKT is not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
IX. Liability of Users
Users are liable for all content and actions on the platform and shall indemnify LA OL’ MARKT upon first request if they are responsible for any infringement.
The indemnity also covers the costs of reasonable legal defense.
Users are obliged to inform LA OL’ MARKT immediately and fully if claims are made by third parties.
X. Final Provisions
The contractual language is German. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If any provision of these Terms is invalid, the validity of the remaining provisions remains unaffected.
Users may terminate the user agreement at any time by submitting a written declaration (e.g., by email). LA OL’ MARKT may terminate with 14 days’ notice.
LA OL’ MARKT is entitled to transfer rights and obligations arising from the user agreement to third parties.

These Terms and Conditions apply exclusively to the use of the platform by sellers and buyers. For sales conducted via the platform, the respective seller is responsible for complying with statutory provisions on distance selling, warranties, returns, etc.
